Information on our privacy statement

Any personal information collected during visits to our websites is processed in accordance with the provisions of German law. Our data protection policy also complies with the internal data protection guidelines of the All Yacht Services LTD Group.

Our websites may contain links to other providers’ websites that are not covered by this privacy statement. All Yacht Services LTD respects your personal privacy.

Collection and processing of personal data

All Yacht Services LTD stores your personal information if you provide it to us yourself, e.g., during registration, surveys, competitions, or contractual transactions (e.g., booking a cruise). We also analyze traffic to understand customer requirements and improve our site. IP addresses are collected but not linked to specific persons; only anonymized data is used for statistics. Data for error analysis is stored temporarily (2 weeks). Cookies track preferences and improve design. Submitted ratings are anonymized before being sent to third-party suppliers. Use of the web analysis tool Google Analytics

All Yacht Services LTD uses Google Analytics for anonymized access measurement. Cookies store anonymous data; IP addresses are anonymized. Only authorized personnel have access. The anonymized data is sent to Google Analytics servers in the USA.

Limitations on use and disclosure of personal data

All personal data is processed solely for website-related services (including newsletter) to offer customized services and avoid duplicate entries. Data is not shared with third parties. Some services (FAQ) store data temporarily only for responding to inquiries. Government requests comply with legal frameworks; confidentiality is maintained according to German law.

Opt-in / Opt-out

Users can choose to receive communications about products, services, and surveys. Preferences can be changed anytime in 'Newsletter and SMS services' under 'My Account' > 'My Profile'.

Payment Methods

Payment processing via PayPal

We offer payment through the service provider PayPal. The provider is PayPal Europe S.à r.l. et Cie, S.C.A., 22‑24 Boulevard Royal, L-2449 Luxembourg.

If you choose to pay with PayPal, the payment data you enter will be transmitted to PayPal. This may include your name, address, email address, IP address, and payment information. The transmission of this data is necessary for PayPal to process the payment and to carry out identity and security checks.

The processing of your data is based on Art. 6(1)(b) GDPR (performance of a contract) and, where required, on Art. 6(1)(a) GDPR (consent), for example if you agree to the transfer of your data to PayPal during the checkout process.

PayPal may use the transmitted data for its own identity and credit checks as well as for fraud prevention. Further information on PayPal’s data processing can be found in PayPal’s Privacy Policy at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.

Payment processing via Revolut

We offer payment through the service provider Revolut. The provider is Revolut Payments UAB, Konstitucijos ave. 21B, 08130 Vilnius, Lithuania.

If you choose to pay with Revolut, the payment data you enter will be transmitted to Revolut. This may include your name, address, email address, IP address, and payment information. The transmission of this data is necessary for Revolut to process the payment and to carry out identity and security checks.

The processing of your data is based on Art. 6(1)(b) GDPR (performance of a contract) and, where required, on Art. 6(1)(a) GDPR (consent), for example if you agree to the transfer of your data to Revolut during the checkout process.

Cookies: Personalized surfing

To ensure that our service is as userfriendly as possible we use so-called cookies and web beacons.

A “cookie” is a small text file which a webserver (for example the www.daycruisemalta.com webserver) sends to your browser when you visit a website. So-called “session cookies” expire at the end of the browser session and can capture your activities during the browser session. In contrast to these, there are “permanent cookies” which are saved on your terminal and these are able to capture your settings or activities on multiple websites.

Web beacons are small graphic data (also known as ‘Pixel Tags’ or ‘Clear GIFs’), which can be included in our websites, apps, applications and newsletters and are usually used in combination with cookies to identify users and user behavior. The above mentioned statements about cookies apply accordingly for web beacons; web beacons will in particular not be used in case you objected to the use of the relevant cookie.

Cookies pose no risk to your computer, as they are simply text files and not executable programs.

The cookies on the All Yacht Services LTD website (daycruisemalta.com) are used both to ensure convenient browsing and for market research and advertising purposes, as well as to collect statistics on use. We also use cookies for the purpose of web tracking, and they form the basis of your personalised content.

Besides so-called “session cookies” which are deleted when you end your browser session, we put in place permanent cookies. Cookies are stored until deleted by the user. No personal data is stored in the cookies used by us.

It depends on your browser’s settings as to whether the cookie file is stored or deleted. If the file is stored, our webserver can recognise your terminal. Conditions for Day-Cruises Organized by All Yacht Services Ltd., Malta 2018

Contracts of carriage are entered into with All Yacht Services Limited (“AYS”) and tickets are issued subject to these terms and conditions, which the passenger by purchasing a ticket acknowledges having read and understood and agrees to be bound by. Verbal promises or representations by booking agents or AYS’ employees and agents will not be recognized if they are inconsistent with these terms and conditions.

  • 1. AYS reserves the right to change prices, arrange alternative transport, modify itineraries and services in any way, or cancel departures without liability to the passenger if deemed necessary.
    Once the charter agreement has been signed by both parties and the deposit received, the price will not change as long as no services are added or canceled. Alternative transport must be agreed upon in advance. For cancellations, see point 14.
  • 2. AYS shall not be liable for any damage, loss, or injury arising or alleged to arise directly or indirectly in the event of cancellation, change, variation, or abandonment of the service before or during it (if AYS or its employees/agents decide at their discretion that it is necessary) or any change or delay for any reason.
    For clarity, AYS shall also not be liable for accommodation costs or alternative travel expenses, which remain the sole responsibility of the passenger.
  • 3. AYS may, without assuming liability to the passenger, arrange for any other person to perform the contracted service (“performing carrier”), and the performing carrier and their employees/agents shall enjoy the same terms as AYS as if they were party to the contract.
  • 4. All services are subject to sea and weather conditions.
  • 5. AYS is not a common carrier and reserves the right to refuse to carry any passenger or goods without explanation.
  • 6. Each full-fare passenger is entitled to transport up to 10 kg of luggage free of charge.
  • 7. Passengers must comply with instructions from AYS employees and agents regarding all matters related to the service, including the personal safety of the crew, themselves, or other passengers.
  • 8. Passengers must be able to swim at least 500 meters; otherwise, wearing a life jacket during the entire cruise is mandatory.
    Passengers are required to take all reasonable precautions for the safety of those in their care (especially children) and their own safety. This includes, but is not limited to, using handrails and guardrails, properly restraining children, ensuring children are accompanied by a responsible adult, paying attention to safety briefings by crew members, and being seated when advised. Extra care must be taken in rough or inclement weather as instructed by AYS employees.
  • 9. Passengers must not consume alcohol or intoxicating beverages unless sold or supplied on board by AYS. No food or drinks may be brought on board without prior written agreement.
  • 10. Passengers must not bring explosives, volatile spirits, corrosives, flammable items, or offensive objects that could inconvenience others or endanger the vessel, passengers, or goods. Smoking is prohibited on board.
  • 11. AYS is not responsible for damage, loss, or injury to luggage, personal effects, or passengers related to the service, accommodation, or transfer between vessel and accommodation, whether partly due to negligence or fault of AYS, its employees, or performing carrier.
  • 12. AYS shall not be liable for loss of money, negotiable securities, gold, silverware, jewelry, or other valuables, even if deposited for safekeeping, regardless of fault or negligence.
  • 13. If a claim is made against an AYS employee or performing carrier arising from damages covered under the contract, the employee may invoke the same exclusions and defenses as AYS.
  • 14. In case of passenger cancellation, AYS may charge fees according to its refund policy:
    If weather forecasts indicate Force 6 or higher or rough seas, either party may cancel and receive a full refund if canceled 48 hours before charter.
    For other reasons, the cancellation fee is 100% of the boat price.
    In case of sudden unsafe weather, the captain may cancel the cruise.
    Refunds will be processed minus bank and/or credit card fees which are non-recoverable by All Yacht Services Ltd.
  • 15. The contract is governed by Maltese law and the passenger submits to the exclusive jurisdiction of Maltese courts.
  • 16. If any term is found invalid or unenforceable, it is severable and all other terms remain in effect.
  • 17. No other terms shall be recognized without written agreement between AYS and the passenger.
  • 18. A deposit of 50% is required to secure the date; balance is due at embarkation.
